The Michigan Supreme Court will let stand the conviction and life sentence of an elderly Ionia County man who killed his daughter after she verbally abused him.
Donald Glenn Lasley, 76, was sentenced to life in prison for the May, 2013 shooting death of his daughter. An Ionia County jury convicted him of murder and a firearms offense.
Lasley appealed the verdict, saying he was denied a fair trial because he couldn’t use "battered person syndrome'' as a defense.
Lasley said he killed his daughter with a shotgun blast to the face after she verbally abused him.
He called 911 to report the Saturday afternoon shooting, then waited outside for police to arrive. Jacquie Lasley Osterhout, 37, died at the scene.
Lasley told detectives the shooting was the culmination of seven years of 'intolerable behavior' by his daughter.
In a six-page decision released in December, the Michigan Court of Appeals said it found no connection between battered person syndrome and Lasley's contention the Memorial Day weekend shooting was accidental.
Lasley "never raised a claim of self-defense, arguing instead that this was an accidental shooting,'' the Appeals Court wrote in upholding his conviction.
The Michigan Supreme Court, in a one-page order released this week, said it would not take the case “because we are not persuaded that the question presented should be reviewed.’’
Lasley is at the Carson City Correctional Facility in Montcalm County.
