GRAND RAPIDS, Mich. — Kent County Prosecutor Chris Becker made an announcement Tuesday on his charging decision in the death of a teen who was hit by a Kent County Sheriff deputy patrol car.
Riley Doggett, 17, died May 9, weeks after he was hit by a sheriff patrol car during a chase.
The other teenager who was driving the stolen car faces fleeing and eluding causing death and continuing criminal enterprise.
The prosecutor plans to ask the court to charge him as an adult.
The deputy who tried to cut Doggett off with his vehicle as he was running from authorities will not face any charges, Becker said.
Becker said the deputy thought Doggett was running with a gun in his hand, but it was later determined to be a cell phone.
Dashcam video shared Tuesday afternoon shows the deputy's car following Doggett running, going up over a curb and hitting him.
The prosecutor said he believes Doggett got caught in the wheel, and slammed his head onto the ground.
"I found no basis to charge the deputy in this circumstance," Prosecutor Becker said.
"He could've gunned it and went right at him...and he did not do that. He's trying to cut him off. He cut it too close, and obviously, there are tragic results," Becker said. "It happens. It's a horrible thing to occur."
Becker said he talked to Doggett's family about his decision, and he said they are not happy with it.

Deputies said Riley Doggett was an occupant in what they believe was a stolen vehicle connected to several crimes in Kent County when they attempted to stop the car.
They said Doggett did not stop and a brief chase began.
Officials said Doggett and one other person then got out of the car and attempted to run while the vehicle was still in motion.
They said Doggett was hit by a deputy's vehicle and seriously injured. He later died from those injuries.
Michigan State Police conducted the investigation into Doggett's death and provided that report to Becker.
Doggett's family is calling for transparency from the Kent County Sheriff's Office, and asking for the release of the dashcam footage from the patrol car that hit and killed him.
In a press conference last Friday, just hours before Doggett's funeral, his family called for justice alongside their lawyer, Ven Johnson, and former Kent County Commissioner Robert Womack.
The family said the only information they received from police after the incident was from a Michigan State Police detective who said the officer was trying to use his vehicle for a pit maneuver.
The sheriff's office, however, said that more information on Doggett's death would be released in the future.
“We are waiting on the Prosecutor’s evaluation of all the evidence. KCSO will release something when this review has been completed," reads a statement.
