NEW INFO | Driver who hit hayride in Allegan Co. had alcohol in system, now faces OWI charge

The driver who hit a hayride on M-40 in Trowbridge Township is facing one count of Operating While Intoxicated Causing Serious Injury.

TROWBRIDGE, Mich — On Saturday, there was a crash at the intersection of M-40 and 110th Ave. in Trowbridge Township. An SUV struck a tractor pulling a hay wagon.

There were nine passengers aboard the wagon. They were on their way back from a nearby restaurant during a hayride.

"The trailer was turned on its side, the tractors in an awkward angle," said Allegan County Sheriff Captain John Paul Damveld. "Yes, there was debris in the roadway."

Allegan County Sheriff's Office Deputies responded to the scene around 7:45 p.m. Saturday night.

"The tractor itself had lights on it," said Cpt. Damveld. "There were no lights on the hay trailer, but there was a large, slow-moving reflective orange triangle on the back of it."

According to Cpt. Damveld, the driver of the SUV was charged with one count of Operating While Intoxicated Causing Serious Injury. 

Her blood alcohol content at the time was .12, which is over Michigan's legal limit of .08. Damveld said that more charges could be filed in the future.

"If we find out that it meets the elements of the crime, of the serious injury, it could be one charge for each person that is, you know, falls under that criteria, the serious injury," said Cpt. Damveld.

Five people were transported to the hospital with serious but non-life-threatening injuries, according to Cpt. Damveld. Three of those people were on the wagon and two were in the SUV.

The drivers' arraignment will happen Tuesday afternoon, according to Cpt. Damveld.
